What is a Class Action Lawsuit?

Class action lawsuits work like this: an initial plaintiff brings a claim against the company for a defective product. We investigate whether other people have been harmed in the same way to join the class. Once the class is certified by the court, there will be discovery, or the exchange of evidence, between the class of plaintiffs and the defendant company. After discovery, there may be a settlement or a trial on the issues. Once the settlement has been approved by the court or a verdict has been rendered, the plaintiffs in the class action will receive their portion of the award.

What is Multidistrict Litigation or MDL?

Multidistrict litigation, known as MDL, is a different process than class action lawsuits. MDLs typically involve defective pharmaceutical drugs or recalled medical devices. MDLs are also known as mass tort litigation.

One individual will file a lawsuit against the responsible company. If other cases across the nation involve the same issue, a federal judge may combine all the cases throughout the country into one courtroom. This federal judge will then oversee pre-trial issues like liability and discovery (the exchanging of evidence.) After the pretrial proceedings have finished, the separate lawsuits will be sent back to the home states where the individuals live for trial. Therefore, unlike a class action lawsuit, in an MDL, individuals still proceed with their own trials in their home states. Multidistrict litigation does not give the same amount of damages to every individual case. Damages in an MDL will be determined on a case-by-case basis, unlike a class action lawsuit.
