GlaxoSmithKline (GSK), the pharmaceutical company behind the anti-nausea drug Zofran, has filed a request for dismissal in a lawsuit against it regarding birth injuries connected to Zofran. Many products liability cases involve a request for dismissal; often, it is the first move the defendant makes. The courts have not yet ruled on the dismissal request.
Zofran Lawsuits
We wrote about the case in question in one of our previous blogs. An Alabama woman filed the lawsuit after her child was born in 2006 with multiple birth injuries including heart problems, musculoskeletal deformities and long term health issues. The mother claims to have taken Zofran during the first trimester of her pregnancy in order to treat her morning sickness. Despite its widespread use for this purpose, Zofran has never been approved for the treatment of morning sickness.
This lawsuit is among the first filed against GSK this year.
The safety of Zofran for pregnant mothers and developing fetuses was the subject of a high-profile lawsuit in 2013. GSK allegedly promoted the drug for its off-label use despite a lack of research into the effects of the drug on fetuses, and what little research the company did have showed abnormalities in animal fetuses as well as intrauterine fetal demise, in some cases.
